Even an illegal unit in a 2-unit building in San Francisco can block your ability to convert to a condominium.
If the illegal unit has been rented in the past then it can – and probably will – be looked at by city planning as a rental unit. City planning is hesitant to take any rental units off the market, and they are the ones that decide if it is a 2- or 3-unit building.
Make sure you speak to an attorney before you purchase a 2-unit building with an illegal unit.
